1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Student", "User", or "Guardian") and Think Musical Academy ("Academy", "we", "us", or "our"), a music education institution operating in Mumbai, Maharashtra, India.

By accessing our website, completing the registration process, purchasing Session Coins, or attending any class, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you are registering on behalf of a minor (a person under 18 years of age), you represent that you have the legal authority to do so and that the minor and you will comply with these Terms.

If you do not agree with any part of these Terms, you must not register with or use the Academy's services.

2. Eligibility & Registration

To enrol with Think Musical Academy, you must meet the following requirements:

The Academy reserves the right to refuse registration or terminate any account at its sole discretion, particularly in cases of fraudulent, abusive, or inappropriate conduct.

Account Responsibility

You are solely responsible for all activities conducted under your account. The Academy shall not be liable for any loss resulting from unauthorised access to your account caused by your failure to maintain account security.

3. Our Services

Think Musical Academy provides music education services in the following formats:

Instruments currently taught: Guitar, Piano, Ukulele, and Mandolin. The Academy may add or remove instruments from its curriculum with 30 days' notice.

All classes are subject to teacher availability. The Academy does not guarantee the assignment of any specific teacher and reserves the right to reassign teachers based on availability, expertise, or operational requirements.

4. Session Coins & Payments

What Are Session Coins?

Session Coins are the Academy's proprietary booking currency. They are purchased by students and used to book individual sessions. Coins have no cash equivalent and are non-transferable.

Validity

Expired coins are automatically forfeited. No extensions or cash refunds will be provided for expired coins. Please refer to our Refund Policy for full details.

Pricing Changes

The Academy reserves the right to modify coin pricing at any time with 30 days' advance notice to enrolled students via their registered email address.

5. Booking & Attendance

Sessions are booked through the student dashboard using the slot grid. The following rules apply:

No-Show Policy

A session is marked as "no-show" if the student is absent or unreachable within 15 minutes of the scheduled start time without prior notice. No coin refund is issued for no-shows. Three or more no-shows within a 30-day period may result in a temporary suspension of booking privileges.

6. Cancellation & Rescheduling

Summary: Cancel more than 12 hours ahead for a full refund. Between 2–12 hours requires a Reschedule Coin. Under 2 hours requires an Emergency Coin. No refund for no-shows.

Student-Initiated Cancellations

Academy-Initiated Cancellations

If the Academy cancels a session due to teacher unavailability, technical failure, or force majeure, the full Session Coin cost will be refunded to the student's wallet. No additional compensation will be provided.

Group Cancellations

For group or mini-group bookings, cancellation by one group member cancels the entire group's booking for that slot. The cancellation rules above apply to the group wallet as a whole.

7. Code of Conduct

All students, guardians, and group members must:

Violation of the Code of Conduct may result in immediate suspension or permanent termination of enrolment without refund of any unused coins.

8. Intellectual Property

All content produced by Think Musical Academy — including but not limited to teaching materials, lesson plans, course structures, worksheets, video recordings, and software — is the exclusive intellectual property of Think Musical Academy.

Students are granted a limited, personal, non-commercial licence to access and use Academy materials solely for their own educational purposes. This licence does not permit reproduction, distribution, resale, public performance, or derivative works without express written permission from the Academy.

The Academy's name, logo, and branding are registered trademarks. Unauthorised use is strictly prohibited.

9. Privacy & Data

The Academy collects personal data (name, contact details, date of birth, address, guardian details for minors) solely for the purposes of enrolment management, session scheduling, and communication.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Think Musical Academy shall not be liable for:

The Academy's total aggregate liability in any circumstances shall not exceed the value of coins held in the student's wallet at the time of the claim.

11. Changes to Terms

Think Musical Academy reserves the right to modify these Terms at any time. Material changes will be communicated to enrolled students via the registered email address at least 14 days before taking effect. Continued use of the Academy's services after that date constitutes acceptance of the updated Terms.

It is your responsibility to review these Terms periodically. The current version is always available at thinkmusical.com/legal/terms.html.

12. Governing Law & Disputes

These Terms are governed by the laws of the Republic of India. Any disputes arising from or relating to these Terms or the Academy's services shall first be attempted to be resolved through good-faith negotiation.

If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the competent courts located in Mumbai, Maharashtra, India. The Academy and the Student waive any objection to the venue or jurisdiction of such courts.
